Can foreign workers in Vietnam authorize their company to handle tax finalization?

Can foreign workers authorize their Vietnamese employers to handle Personal Income Tax (PIT) finalization on their behalf?

“Yes,” according to lawyer Vu Tuan of the Hanoi Bar Association.

Foreign workers may authorize an employer to finalize their PIT as long as they have worked for that employer for at least three months and are still employed at the time of the PIT finalization.

This is pursuant to Point d, Clause 6, Article 8 of Decree No. 126/2020/ND-CP.

According to Article 44.2 of the 2019 Law on Tax Administration and Section V of Document 883/TCT-DNNCN issued by the General Department of Taxation in 2022, if taxpayers want to authorize their income payers to conduct PIT finalization, they must do so before the annual PIT declaration and finalization deadline, which is March 31 of the following year.

Failure to do so means the foreign workers need to conduct the PIT finalization independently, with the deadline to submit their tax finalization dossier being April 30.
